Freedom of Information: Requests for Information

As from the coming into full force of the Freedom of Information Act (Cap. 469), the public can apply for access to internal MEUSAC documents. Such access is granted in accordance with the provisions of the Freedom of Information Act to eligible persons defined as persons resident in Malta for a period of at least five (5) years and who are either citizens of Malta, a European Union Member State or any other State having a treaty arrangement with the European Union granting citizens of that State the right to be treated in EU Members States in the same manner as citizens of European Union Member States.

Eligible persons may request information by filling in the Request for Information Form. A request for accessing a document or information under the FOI Act can be submitted via the e-ID on the FOI Portal (http://www.foi.gov.mt). Now, an online request can also be done without the need for the applicants to register through e-ID. Alternatively, a Request for Document Form can be downloaded from the same website (Downloads Section). The Form has to be completed and submitted by email to foicu@gov.mt or by post to the Office of the Permanent Secretary, Ministry for Social Dialogue, Consumer Affairs and Civil Liberties, Barriera Wharf, Valletta.

The request should clearly state that it is being made in terms of the Freedom of Information Act (Cap. 469) and should include the following:
- the postal or email address at which notices under the Freedom of Information Act may be sent to the applicant.
- Applicants are advised to be precise and to give as much information as possible to aid in the identification of the records containing the information requested.

Requests for information will be chargeable where access to a record is granted in terms of the Freedom of Information Act. The fee shall be chargeable in accordance with the First Schedule of the Fees charged by Public Authorities for Access to Documents Regulations issued under the Act by Legal Notice 158.
